HISTORICAL SKETCH_______

In May of 1964, nine people met "to consider whether there might be a practical basis for doing someithing constructive about their common concern over the serious handicaps under which the state legislatures function." Further meetings, attended by more people from various public and private interests, led to the formation of the "Citizen's Conference on State Legislatures," a Missouri nonpprofit corporation, which held its first meeting on Janurary 26, 1965, in Chicago. Horace E. Sheldon was elected chairman, Warren A. Patterson was elected vice-chairman, and George H. Morgan was elected secretary-treasurer. Mr. Morgan later resigned as a trustee of the corporation in order to accept the paid position of Interim Secretary of the Conference whose duties were to "conduct the necessary business of the Conference as directed by the trustees."

It was decided that problems of the state legislatures should be dealt with on a state by state basis, rather than by formulating a uniform prescription for national application. The main approach for bringing about the desired changes was to be through three kinds of activity: research, public information, and liaison with national, state and local organizations and leaders.

Governor Terry Sanford, of North Carolina, and former governor of Kansas, John Anderson, Jr., were early and active participants. Governor Sanford was one of the first trustees, while Governor Anderson served as Executive Director of the CCSL, a paid position.

Throughout 1965, the Conference concentrated its efforts on organization, fund raising, and some research on various state legislatures. For the first two or three years, meetings of the Board of Trustees were held at somewhat irregular intervals from six months to a year apart. Later, board meetings were held at more frequent intervals. By 1967 there was some evidence of funding difficulties, which resulted in the resignation of some staff members. During the November 3, 1969, meeting of the Board of Trustees, discussions took place concerning the possible, or eventual, phase out of the CCSL.

From 1969 through 1971 the CCSL conducted a Legislative Evaluation Study (LES), which resulted in information that was made available in three forms. They published both a popular and technical report on the legislatures in 1971. The popular version was called The Sometime Governments, published by Bantam Books, Inc. The technical version was publishedby Praeger and called State Legislatures: An Evaluation of their Effectiveness. The data collected in the LES was also made available through a computer at the Univerisity of California, Berkeley, with intention of having it updated. The intention was to implement the recommendations of the LES in seven states, toward which the Ford Foundation - a major supporter of CCSL from the beginning - contributed a $1 million grant.

CCSL moved from Kansas City, Missouri, to Denver, Colorado, in August of 1975, leasing 8000 sq. ft. in the Plaza Marin III, south of Denver. Their operating budget for that year was $2.5 million, provided mainly by project grants, contract fees and unrestricted grants.

While the toal funds available to the CCSL had risen from $60,000 in 1965 to $2.5 million in 1975, the percentage of those funds which were unrestricted had dropped from 100% to only 10%.

In 1972 the CCSL began a program called the Program for Legislative Improvement (PLI), which targeted seven states to receive attention in assisting citizen groups in achieving improvements in their legislatures. Those states were Colorado, Ohio, Massachusetts, Arizona, Minnesota, Louisiana, and New Hampshire.

In August of 1975 the CCSL decided to change its name to "Legis/50, The Center for Legislative Improvement" to avoid the confusion of its name with the National Conference of State Legislatures, also based in Denver. The actual adoption of the new name occurred at the February 3, 1976, meeting of the Executive Committee of the Board of Trustees.

Some other major projects which were undertaken by Legis/50 were the Model Committee Staff Project in Juvenile Justice (MCSP/JJ), the Legislative Ethics Project (LEP), and the Legislative Professional Staff Project on Drug Abuse and Alcoholism (LPSP).

The Model Committee Staff Project in Juvenile Justice was an outgrowth the Status Offender Project of 1976. The Status Offender Project was a case study of legislative policymaking in juvenile justice in Alabama, Florida, Michigan and New Mexico, and funded by the Law Enforcement Assistance Administration (LEAA). The MCSP/JJ was funded by the Office of Juvenile Justice and Delinquency Prevention of the LEAA. The principal objective of the project was to create within participating legislatures the capacity to take the initiative in devising innovative state approaches to juvenile justice matters--in other words, legislative action, rather than legislative reaction to federal or state executive branch initiatives. The project provided two professional staff members to the judiciary committees in each selected state.

The Legislative Ethics Project was funded by the National Endowment for the Humanities, and consisted of special seminars for state legislators designed to make them think about the ethical dilemmas with which they might be confronted.

The Legislative Professional Staff Project on Drug Abuse and Alcoholism, like the MCSP/JJ provided professional staff to the committees of five selected states in an attempt to stimulate legislative action in developing sound policies dealing with drug abuse and alcoholism. The LPSP was funded by a combined grant from the National Institute on Alcohol Abuse and Alcoholism, the National Institute on Drug Abuse, and the National Highway Traffic Safety Administration.

In October of 1979, James Arnold, executive director of Legis/50, reported that cutbacks in both staff and research were necessary, due to increasing damands of creditors for immediate repayment of debts.

Legis/50 continued to work, with variable success, on several projects through early 1980. However, in March of 1980 they decided to terminate their employee pension fund, which was $27,000 in arrears at the time.

On May 23, 1980 Legis/50 reported that they were unable to pay their employees because Midwest National Bank, of Indianapolis, had seized over $110,000 from the Legis/50 account in that bank. Many checks had already been written on the account, and could not be made good.

On May 28, 1980, James Arnold stated that Legis/50 had had financial problems since 1977, when Colorado National Bank had seized $162,000 of a 175,000 Law Enforcement Assistance Agency (LEAA) grant. The LEAA then demanded immediate repayment. Legis/50 had been in the process of repaying this money when the second seizure of funds occurred. There were, in addition to the Colorado National Bank, at least 10 other creditors (most in the Denver area), with a total of over $435,000 worth of unsecured loans outstanding against Legis/50.

Finally, on June 21, 1980, James Arnold reported that a telephone conference of the Legis/50 executive board had decided to liquidate the organization.

At the time Legis/50 folded, they had completed several projects, but still had some that were unfinished, and others that were being proposed or contracted for.

SCOPE AND CONTENT_______

Most of the material in the first three boxes of this collection are minutes of the board of trustees and the Executive Committee of the Board of Trustees. They are arranged in Chronological order, beginning with the first meeting on January 26, 1965 and progressing to the Executive Committee Meeting for March 27, 1980.

In addition to being a record of what transpired at each meeting, the "minutes" often included information on such things as the names and offices of individuals serving the organization, resolutions, proposals, correspondence, budget and finance statements, articles of incorporation and constitutional by-laws, program descriptions, conference announcements, agendas and summaries, project reports, biographies of board members and candidates for board membership, lists of sponsoring foundations and their contributions, reprints of newspaper articles about the organization and its personnel, memorandums, and transcripts.

The fourth box, in addition to extensive financial information for 1975, contains minutes of some of the committees and auxilliary organizations, such as the Business Advisory Council. There is an extensive background and objectives report on the Legislative Professional Staff Project on Drug Abuse and Alcoholism for 1975, including background information on several state governments. There are also photographs of the Board of Trustees Meeting for September 22-23, 1971, including background information on several state governments. In the next box are materials related to both internal and external communications of the organization such as Research Memorandum, Information Bulletin, News Letter, and Legis 50 Letter. There are also press releases and photocopies of articles in the U.S. press that were generated as a consequence of the release of the results of the Legislative Evaluation Study in 1971. The 1975 report of the Media Task Force analyzed the role of the press in informing the public of the performance and activities of their legislatures. It pointed out the inadequacy of legislative reporting and made recommendations for improving this press function.

In the same box are letters of application, and related information for staff positions in the Model Committee Staff Project in Juvenile Justice (MCSP/JJ). Other material on this project will be found in box 13.

In box six are some of the booklets and pamphlets produced by CCSL-Legis/50, including a 3 volume study guide for CCSL staff, which contains a copy of the full text of the Legislative Evaluation Study Questionnaire.

Boxes 7 and 8 contain a sampling (5 states - Arizona, Missouri, South Carolina, Oklahoma, Louisiana) of the records kept in CCLS- lEGIS/50 piles on their activities in those states. Included are correspondence on the various ongoing projects (and other matters), and monthly reports on those same projects. Some records of the purposes and accomplishments of trips by staff members were made. Media releases and responses are included.

Box 9 contains CCSL-Legis/50 files on Sunshine Laws covered both the federal and state laws. There are clippings from magazines and newspapers, government documents, etc. Articles and pamphlets from organizations such as Common Cause and the Freedom of Information Center discussed the pros and cons of both Sunshine Laws and Privacy Laws.

In addition to a general file, there are files specific to the Sunshine Laws and their effects in thirteen states (including Colorado). Some of the topics covered in the files are freedom of information, privacy for individuals, registration of lobbyists, and opening up government meetings to the public.

In October of 1976, and Amicus Curiae brief was submitted by CCSL- lEGIS/50 in behalf of the state legislature's position in the Commonwealth Court of Pennsylvania case of Shapp vs. Sloan and the Pennsylvania General Assembly. The Pennsylvania legislature decalred that it had the right to appropriate all funds spent within the Commonwealth of Pennsylvania, even if those funds came from the Federal Government. The brief, memos and other correspondence generated by the case, and court records are included in the files, including news releases announcing the court's decision in behalf of the legislature.

The Ethics files begin with a continuation of the Sunshine- Privacy discussion, then move on to discuss other aspects of governmentalethics. The files are similar in nature and content to the Sunshine files, except for being broader in scope and volume.

Some of the issues dealt with in the Ethics files (which extend from box 9 through box 11) are: campaign financing, financial disclosure, open government meetings, regulation of lobbyists, conflict of interest, freedom of information, political and personal use of public employees by legislators, legislator income restrictions, etc.

There is information about the Legis/50 legislative Ethics Project, which sought to expose state legislators to the ethical dilemmas they would face and to increase their awareness of their own values and decision-making methods.

The format of materials in the Ethics files includes: handwrittenand typed memos, correspondenc, newspaper and magazine clippings, pages from the Congressional Record, government documents, slip laws and slip decisions, pamphlets and booklets from organizations other than Legis/50, typed proposals, essays, etc., news releases, copies of bills, copies of regulations, lobbyist registration forms and disbursement reports, copies of speeches, project reports, announcements of conferences, etc.

Box 12 contains materials related to Legislative Reform and Management and Coordination. The General file of Legislative Reform materials basically consists of articles and essays on reform and improvement of State Legislatures. The other files are specific to certain states, but are the same types of materials.

The Management and Coordination files contain articles, pamphlets, etc. related to increasing the efficiency of rules, regulations, procedures, and policies regarding the management and coordination of legislative services, from the election laws that get legislators into power to the methods by which legislators select their own leadership.

Box 13 contains files related to the Law Enforcement Assistance Administration (LEAA) and its support for the Legis/50 Model Committee Staff Project in Juvenile Justice (MCSP/JJ) and outgrowth of the 1976 Status Offender Project. The MCSP/JJ project, and attempts to arrange for both government and private financing. In addition, the MCSP/JJ material has some Arizona monthly reports and a Progress Report newsletter (August 15, 1974 - July, 1977), as well as a 1978 Annual Report on the project and a 1979-80 proposal for the continuation of the project.

The Information Systems files (Box 14) are basically correspondence and articles related to the use of computers by state legislatures. The processing of bills and production of calendars for bill processing are treated as part of this material as well.

The problems and issues of staffing for legislatures are dealt with in the Staffing files, which consist mostly of papers, articles and booklets.

The subjects of separation of powers, diplomacy, and effectiveness of the executive officers of the states in their dealings with the legislatures (and vice versa) are discussed in the Executive-Legislative Relations files. This material is mostley in the form of extracted newspaper articles on the topic.

Grant Proposals (Box 15) range from the evaluation of information- transfer techniques to the repsonsibiltiy of state government for safe drinking water. There are 16 proposals, submitted to various organizations between 1974 and 1979 in an attempt to gain funding for the projects described in them.

While "sunshine laws" dealt with opennes and ethics in government, the "sunset laws" dealt with the laws that would provide for the automatic expirpiration of any state agencies or programs not deliberately renewed by the legislature. The Sunset Law files contain Acts articles, and booklets pertaining to the attempt to establish such laws in the states, and the functioning of those already in place.
